By downloading, installing, accessing, or using the Straddly application and any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service. These Terms constitute a legally binding agreement between you and Pierre-Louis Favreau, sole proprietor, operating under the trade name "Straddly" ("we", "us", "our"), based in France.
You must be at least 13 years old to use the Service. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.

We reserve the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe have been compromised.
Straddly offers both free and paid subscription plans ("Straddly Pro"). Paid features include higher AI usage limits and additional platform capabilities.
Subscription plans:
Add-on purchases: You may also purchase consumable add-on credit packs (e.g., social credits) as one-time, non-refundable in-app purchases.
Billing: All subscription payments and in-app purchases are processed through the Apple App Store or Google Play Store. By subscribing or making a purchase, you authorize the applicable store to charge your selected payment method. Prices are displayed in the app at the time of purchase and may vary by region.
Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your payment method will be charged for renewal within 24 hours prior to the end of the current period.
Cancellation and management: You can manage or cancel your subscription at any time through your device's app store settings (Apple App Store or Google Play Store). Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing period.
Refunds: Refund requests are handled by Apple or Google in accordance with their respective refund policies. We do not process refunds directly.
Restore purchases: You can restore previous purchases by using the restore feature within the app settings.
The Service imposes usage limits that vary by plan (free or Straddly Pro). These limits may apply to:
Usage limits reset on a daily or weekly basis depending on the quota type. We reserve the right to modify usage limits at any time. Current limits are displayed within the app.
The AI coach ("Auguste") provides fitness suggestions, workout routines, and coaching guidance generated by artificial intelligence. You acknowledge and agree that:

You retain ownership of all content you submit to the Service, including but not limited to profile information, workout data, routines, goals, chat messages, photos, and videos ("User Content").
By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, process, and display that content solely for the purpose of providing and improving the Service. This license terminates when you delete your content or your account, except where retention is required by law.
You are solely responsible for your User Content. You represent and warrant that you have all necessary rights to submit such content and that it does not violate any third-party rights or applicable laws.
The Service includes social features such as friend connections, workout sharing, friend tagging in sessions, and invitation links. When you use social features:
With your consent, we may send push notifications to your device regarding workout activity, friend interactions, and Service updates. You can manage notification preferences at any time through your device settings or within the app.
All content, features, functionality, and branding of the Service (including but not limited to text, graphics, logos, icons, software, exercise database, and routine templates) are owned by Straddly or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on any part of the Service without our prior written consent.
You may delete your account at any time through the app settings. Upon account deletion:
We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or engaged in conduct that is harmful to other users, us, or third parties. We will make reasonable efforts to notify you of any suspension or termination. Upon termination, your right to use the Service ceases immediately.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
To the fullest extent permitted by applicable law, Straddly and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or property damage arising from or related to your use of or inability to use the Service.
Our total aggregate liability for all claims arising from or related to the Service shall not exceed the total amount you paid for the Service in the twelve (12) months preceding the event giving rise to the claim, or fifty euros (EUR 50), whichever is greater.
Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
You agree to indemnify, defend, and hold harmless Straddly and its operator from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your use of the Service, or your User Content.
These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France, unless mandatory consumer protection laws in your jurisdiction provide otherwise.
If you are a consumer residing in the European Union, you also have the right to submit a complaint through the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where practicable, by sending a notification through the Service. Your continued use of the Service after the revised Terms take effect constitutes your acceptance of those changes. If you do not agree with the revised Terms, you must stop using the Service.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Straddly regarding the use of the Service and supersede all prior agreements, understandings, and communications.
